Pomerleau commences an arbitration against SNCLCP for recovery of C$6.7M unpaid invoices

On July 19, 2024, Pomerleau commenced an arbitration against SNCLCP for recovery of unpaid invoices. Douglas Harrison was the arbitrator. SNCLCP was represented by Lenczner Slaght LLP. SNCLCP defended the arbitration based on an alleged right to equitable set-off against other unproven claims. Pomerleau was completely successful in the arbitration. SNCLCP applied to set-aside the award and sought leave to appeal before a single judge on the commercial list in Toronto. The application/appeal was unsuccessful and Pomerleau's award of C$6.7 million was confirmed.
