Cross-border DIP financing for Oak and Fort CCAA and Chapter 15 proceedings on behalf of lender group

On June 6, 2025, Oak and Fort Corp. and affiliated companies commenced a cross border proceeding under the Companies’ Creditors Arrangement Act ("CCAA"). We are counsel to a group of debtor-in-possession ("DIP") lenders. We are assisting a group of DIP lenders on the provision of super-priority financing and acted for the lenders in Canadian proceedings, while coordinating with U.S. counsel in the companion Chapter 15 case under the United States Bankruptcy Code.

McCarthy Tétrault is assisting a group of DIP lenders with a team led by Lance Williams that includes Ashley Bowron and Jenna Clark (Bankruptcy and Restructuring).
